Include a statement that you have a good faith belief that the disputed use is not authorised by the copyright owner, its agent, or the law.

4. Where to Send a DMCA Notice

DMCA notices should be sent to:

If a postal notice is required, correspondence may be addressed to the most relevant SoftGlaze entity listed above.

5. What Happens After We Receive a Notice

Once a notice is received, SoftGlaze may take one or more of the following steps:

  • Review the notice for completeness
  • Request additional detail if the notice is unclear or incomplete
  • Investigate the material referenced
  • Remove or disable access to the content temporarily or permanently
  • Notify the person or party who provided or controls the material
  • Evaluate whether a counter-notification may apply
  • Retain records of the complaint for legal, compliance, or administrative purposes

Receipt of a notice does not automatically mean the content will be removed immediately. SoftGlaze reserves the right to assess the validity, specificity, and legal sufficiency of any claim before acting.

6. Counter-Notification Procedure

If you believe that material removed or disabled as a result of a copyright complaint was removed by mistake or misidentification, you may submit a counter-notification.

A valid counter-notification should include:

  • Identification of the material that was removed or disabled and where it appeared before removal
  • Your full name, address, telephone number, and email address
  • A statement under penalty of perjury that you have a good faith belief the material was removed or disabled due to mistake or misidentification
  • A statement consenting, where applicable, to the jurisdiction of the appropriate court
  • Your physical or electronic signature

Counter-notifications should be sent to:

SoftGlaze may review the counter-notification and respond in accordance with applicable law and internal procedure.

7. Repeat Infringer Policy

Where appropriate, SoftGlaze reserves the right to restrict, suspend, or terminate access by users, clients, contributors, or third parties who are determined to be repeat infringers or who repeatedly submit or publish content in violation of copyright rights.

We also reserve the right to act where repeated infringement complaints indicate a pattern of misuse, even where each case is reviewed individually.

8. Misrepresentations

Submitting false, misleading, abusive, or bad-faith copyright claims may have legal consequences.

If you knowingly misrepresent:

  • That material is infringing when it is not
  • That material was removed by mistake when it was not

You may be liable for damages, costs, or other consequences under applicable law.

SoftGlaze reserves the right to disregard notices or counter-notices that appear abusive, fraudulent, incomplete, or materially misleading.

9. Third-Party Content and Platforms

SoftGlaze may reference, embed, link to, or build upon third-party platforms, tools, plugins, media, or client-provided materials.

SoftGlaze is not automatically responsible for copyright infringement arising solely from:

  • Third-party platforms outside our control
  • Client-supplied content
  • External websites linked from our site
  • Third-party embedded content managed by others

However, where we receive a proper complaint relating to content present on or through our site, we may investigate and act as appropriate.

10. Client-Provided Materials

Clients and third parties who provide materials to SoftGlaze for use in websites, campaigns, content, design, systems, or other deliverables represent that they have the necessary rights, permissions, licences, or authority to use such materials.

SoftGlaze reserves the right to:

  • Refuse the use of questionable materials
  • Request proof of licence or ownership
  • Remove or suspend use of disputed materials
  • Require replacement content where legal clarity is lacking

Clients remain responsible for the legality of materials they supply unless otherwise agreed in writing.

11. Reservation of Rights

SoftGlaze reserves all rights to:

  • Review and interpret infringement notices
  • Request further evidence
